        <![CDATA[<p>King County based Oak Harbor Freight Lines, Inc. prevailed in its US District Court lawsuit against Sears Roebuck &amp; Co., to recover over $400,000 in unpaid freight charges. In a published opinion dated January 18, 2008, the Ninth Circuit Court of Appeals upheld the decision of the District Court.   Oak Harbor was represented by LHS attorney Ken Hart.       <title>Alert For General Construction and Specialty Subcontractors!</title>
      <description>
        <![CDATA[<p>Because of the recent proliferation of construction defect litigation, the insurance industry has tightened up the underwriting requirements for general contractor liability insurance coverage.  One result of this development is that more and more general contractors are now requiring that each of their subcontractors sign a form, Subcontractor Master-Agreement, the provisions of which then apply to each project or job the subcontractor performs for the general contractor.  In our experience, these agreements, although similar in some respects, can be quite different from one another.  Some tend to be reasonable and even-handed, while some definitely favor the general contractor, and may include provisions that could put the subcontractor at a distinct disadvantage in the event of a contract dispute.</p>
        <p>If you are asked to sign one of these agreements, do not assume, therefore, that it is just a “standard contract” and that you have nothing to worry about.  Instead, we strongly recommend that, before you sign, you consult with one of our attorneys.</p>
